Jersey chemical safeguards won't be weakened by feds

New Jersey's strict chemical se curity laws cannot be pre-empted by weaker federal standards under legislation U.S. Sen. Frank Lauten berg (D-N.J.) sponsored and celebrated with a host of other Garden State officials and civic leaders in Jersey City yesterday.

The provision was tucked into a $555 billion spending bill, signed into law Dec. 26 by President Bush, that continued funding for the Iraq War. In a parking lot yesterday overlooking the Kuehne chemical plant, Lautenberg was joined by state Department of Environmental Protection Commissioner Lisa Jackson and other officials in hailing the chemical security measure.

Lautenberg said it will prohibit Washington from overriding New Jersey's chemical security laws, stronger than federal standards, and will let other states adopt tougher rules without federal interference.

"I made a promise in this same spot that I would fight to make sure that states could protect their residents from chemical attacks, and now they can," Lautenberg said.
He was referring to a 2006 news conference in which he announced he would take on a Bush administration plan to adopt regulations giving the Department of Homeland Security control over chemical facility security.

The potential for catastrophic accidents at chemical facilities has long been a concern. But the terrorism of Sept. 11, 2001, left officials worried that such attacks could be directed at industrial sites. New Jersey, home to a high concentra tion of chemical plants, also is the most densely populated state in the nation.

New Jersey adopted several new regulations regarding access to the plants, possession of firearms and security guards. Additionally, some of the most potenti ally dangerous facilities were re quired to investigate safer technologies for their operations.
"In that regard, New Jersey is miles and miles ahead of where the federal government is now," Jackson said.

Industry organizations, however, argued for a single, national standard. New Jersey industry representatives also contended that industrial operations already prac ticed strict security and operating measures, and were among the safest in the nation.

Homeland Security Secretary Michael Chertoff additionally vowed last year not to permit stricter state security laws to prevail as the federal standards were adopted. But many civic groups and New Jersey officials remained unconvinced, contending the Bush administration was too cozy with industry.

Rick Engler, director of the New Jersey Work Environment Council, a coalition of 70 labor, environmental and community groups, said DEP records cite 332 industrial facilities that could pose significant safety and health risks in the event of a toxic release.
"The Work Environment Council commends Sen. Frank Lauten berg for protecting the health, safety and security of New Jersey workers and residents by standing up to the chemical industry lobby ists and executives who too often value corporate profits over the public's interest," Engler said yesterday.

He said federal regulations are silent on operations at water treatment plants, but New Jersey is not. In addition, New Jersey regulations encourage workers at the most dangerous chemical facilities to point out hazards during DEP inspections.

Oil spills into Lake Kenosia

Between 75 to 80 gallons of heating oil leaked out of a home fuel tank Tuesday and onto the shore and water of Lake Kenosia. Firefighters responded to a report of a fuel spill at 85 Boulevard Drive after a neighbor spotted a red slick in the water. Firefighters were dispatched about 12:20 p.m., according to Danbury Fire Department Assistant Chief Stephen Williams. The homeowner received an oil delivery about two weeks ago. "The tank had developed a small hole and had rusted through from the outside," Williams said.

Oil leaked onto the homeowner's backyard and into Lake Kenosia. Danbury firefighters contacted the state Department of Environmental Protection and the Danbury Health Department, as the lake is part of the city's water supply. However, the city is not pumping water from the lake, said Mayor Mark Boughton. The cleanup and removal of the leaking tank are being handled by Connecticut Tank Removal.
